Our office is Certified as a Course Provider to conduct Bureau of Automotive Repair Remedial Training for any size organization. The number of participants is unlimited.

The training will include the required Remedial Training Course Content required per California Code of Regulations § 3395.7 including but not limited to:

  1. Estimate Requirements (section 3353);
  2. Customer Authorization (sections 3353.1, 3353.2, and 3354);
  3. Invoice Requirements (section 3356);
  4. Accepted Trade Standards (Article 8);
  5. Sublet Repair (section 3353(d));
  6. Return of Parts (section 3355);
  7. Advertising Requirements (section 3372.1);
  8. Guarantees and Warranties (sections 3375, 3376, and 3377)
  9. Maintenance of Records (section 3358);

Each BAR Certified Remedial Training Course will include Write it Right Training on documenting proper estimates, work orders, and final invoices.

Each course will be custom tailored to address your specific area of licensed Automotive activity – from Smog Testing to General Repair to Auto Body Work.

This course will qualify under California Code of Regulations § 3394.55 for Nondisclosure of Citation for Automotive Repair Dealers if a citation has been issued.

Frequently Asked Questions about BAR Certified Remedial Training

This information addresses the Remedial Training Citation Issue for Licensees. We hope to address who can take the class to avoid the citation becoming public pursuant to current laws and regulations. This information also discusses the statutory basis for BAR’s position and addresses the Responsible Managing Employee (RME) issue.

Who Has to Take the Class?

BAR recognizes a limited set of individuals who control, either directly or indirectly, the business. This definition is limited to owners, directors, officers, partners, members, trustees, managers, and any other persons who directly or indirectly control or conduct the business. BAR license regulations require disclosure of these individuals during the original application process. Any changes must be reported within 30 days.

Depending on the structure of the license, these would include member(s) of an LLC, corporate officers, partners, trustees, etc., that were listed in the original application or whom have since been updated.

If the facility wishes to designate an individual as an Responsible Managing Employee (RME), this person would then be able to complete the Remedial Training Course. Identifying them as an RME would signify this person is “in control” of the business. You would need to officially register this individual with the BAR as an RME.

We do not EVER under any circumstances recommend registering such a person with the Bureau of Automotive Repair as it triggers significant legal liabilities which would be beyond the scope of this page.

Who Should Take the Class?

Everyone at the facility. Just because the BAR mandates only certain individuals are allowed to take the class for Citation Abatement, everyone who talks to a customer, works on a customers car, writes up estimates, invoices, or diagnostic information, needs to know BAR regulations to avoid license discipline issues.

Since the licensee is responsible for the actions of all employees working under the license, everyone working at the facility needs to know how to follow laws and regulations.

What is a Responsible Managing Employee or “RME”?

The Responsible Managing Employee or RME is defined by statute:

16 CCR § 3303 – Definitions
…(v) “Responsible Managing Employee (RME)” means an individual designated by the automotive repair dealer as responsible to oversee the day-to-day operations of the automotive repair dealer and ensure the automotive repair dealer’s compliance with all laws and regulations in conducting its licensed activities…

The issue with identifying the RME to BAR is the creation of legal liability for the licensee. By designating this individual as the RME, you are essentially delegating legal responsibility for the operations of the license to this individual. If he or she works at multiple facilities, or manages multiple facilities, or is found to be personally involved in a particular transaction, a host of liabilities are created under the law – especially for license discipline considerations.

We do not advise ever doing this for reasons that far exceed the scope of this page.

What are the Laws Governing Nondisclosure for the Citation?

A few years ago the BAR created a Remedial Training Course to wipe out citations and prevent disclosure on a licensee’s record. Think of traffic school for BAR licensees. The California Code of Regulations and Business and Professions Code Describes the process:

16 CCR § 3394.55: Nondisclosure of Citation for Automotive Repair Dealers.

(a) The Bureau shall offer to an automotive repair dealer that is eligible for remedial training to prevent the Bureau’s public disclosure on the Internet of a citation as required by Section 27 of the Code, if the requirements in subdivision (b) are met. This offer of remedial training shall be included with the citation notice and shall describe the eligibility criteria and process for completing the training as specified in this section…

(1) The automotive repair dealer meets the requirements for remedial training pursuant to Section 9882(a)(2)(B)(ii) and the cited person is within the categories of eligible persons set forth in Section 9884.7(d)(1). The registrant or other persons who directly or indirectly controls or conducts the business as provided in Section 9884 of the Code and section 3351 shall attend and successfully complete the remedial training…

(b) Each registrant and any other person identified pursuant to Section 9884(b)(3) of the Code who directly or indirectly controls or conducts more than one automotive repair dealer business is entitled to one citation nondisclosure per automotive repair dealer registration.

(c) The registrant may not use the same remedial training course certification of completion for multiple automotive repair dealers

Business and Professions Code 9882 (d) (1):
The director shall establish through regulation a program to certify providers of remedial training for automotive repair dealers who have violated this chapter, employees of automotive repair dealers who have violated this chapter, and persons identified pursuant to Section 9884 as directly or indirectly controlling or conducting an automotive repair dealer business that has violated this chapter.

Discussion of Application to the Remedial Citation Program:

From the language in bold above:

“The registrant or other persons who directly or indirectly controls or conducts the business as provided in Section 9884 of the Code and section 3351 shall attend and successfully complete the remedial training.”

Initial License Application and Update Requirements:

Business and Professions Code 9884 (a)
(a) An automotive repair dealer shall pay the fee required by this chapter for each place of business operated by the dealer in this state and shall register with the director upon forms prescribed by the director…

(b)(3) To the extent prescribed by the director, an automotive repair dealer shall identify the owners, directors, officers, partners, members, trustees, managers, and any other persons who directly or indirectly control or conduct the business.

(b) For the purposes of this section, “controlling individual” means owners, directors, officers, partners, members, trustees, managers, and any other persons who directly or indirectly control or conduct the business…

(e) An automotive repair dealer shall notify the Bureau in writing of any changes to the information submitted to the Bureau under subdivision (a)(2) within thirty (30) days of the date of making any changes…

In short, all initial license applications were required to disclose said persons. The Remedial Training Citation Abatement program specifically defined these individuals as above who could take the class to successfully remediate the citation.
